Interrogatories, request for production of documents, and request for admissions should be sent to the agency attorney. These discovery requests are not sent to EEOC Administrative Judge (AJ). If Agency is not fully compliant, you may seek AJ’s intervention. See AJ’s Acknowledgment Order or Scheduling Order. Many AJ’s require conference with AJ before you can file a motion to compel Agency. Before requesting a conference with AJ, parties must try to resolve discovery dispute—strictly between the two parties. That means, you must give Agency another short deadline to see if Agency would comply. If Agency complies partially—meaning provide some but not all that are requested in your discovery requests—you must enforce your request by sending Attorney a deficiency notice, itemizing each and every non compliant response to each and every discovery request you made. Discovery is the hardest process you may go through, except for the hearing itself. The protocol must be adhered to before you can file a motion to compel.
