180 days after filing a formal EEO complaint, you can file the same complaint with U. S. District Court in the District where the discriminatory actions have occurred, as alleged.
Requesting judicial review by U. S. District Court on a “mixed case” discrimination claims raised in the initial MSPB appeal.
Within 30 days of issuance of the final MSPB decision (or within 30 days of Initial Decision becoming Final MSPB Decision), you may request judicial review of your EEO claims contained in the “mixed case” appeal by filing the same EEO complaint (EEO claims must be same as those in the appeal) at the U. S. District Court in the District of proper jurisdiction, requesting that the District Court review MSPB’s final decision on your EEO claims raised (in affirmative defense) in the initial appeal in a “mixed case.”
