There are 12 regional U.S. Circuit Court of Appeals nationwide and 1 Circuit Court of Appeals for Federal Circuit located in Washington DC.

All U.S. District Court judgments on discrimination cases can be appealed to U.S. Circuit Court of Appeals in appropriate jurisdictional regions nationwide.

All MSPB final decisions (involving otherwise appealable actions) can be appealed only to U. S. Circuit Court of Appeals for Federal Circuit located in Washington DC.

All MSPB cases alleging discrimination (raised as affirmative defense in a "mixed case") can be appealed to U.S. District Court in the appropriate jurisdictional regions nationwide - for review only of discrimination claims.

MSPB final decision in a "mixed cases" may be split and appealed to U.S. Circuit Court of Appeals for Federal Circuit in Washington DC (for review of otherwise appealable actions only with exclusion of discrimination claims) and to federal District Courts within appropriate jurisdictional regions nationwide (for review of discrimination claims only).

If a final decision from MSPB includes decision on EEO claims in a "mixed case," and if it is appealed in its entirety to U.S. Circuit Court of Appeals for Federal Circuit (without abandoning the EEO claims therein); the appeal will be dismissed for lack of jurisdiction. Because U.S. Circuit Court of Appeals for Federal Circuit lacks jurisdiction to review the EEO claims. Such jurisdiction properly belongs to U.S. District Courts, whose decisions can be appealed to U.S. Circuit Court of Appeals within the appropriate jurisdictional regions nationwide.
