U.S. Court of Appeals for pro se

There are 12 regional U.S. circuit courts nationwide and 1 court of appeals for the federal circuit in Washington DC. All District Court decisions or judgments on discrimination claims can be appealed with U.S. Circuit within the appropriate jurisdictional region. All MSPB final decisions (on otherwise appealable actions) can be appealed with the Circuit Court of Appeals for the Federal Circuit in Washington DC. All MSPB cases alleging discrimination (raised as affirmative defense in the initial appeal in a "mixed case") can be appealed with U.S. District Court in the appropriate jurisdictional region nationwide.

MSPB final decision in a "mixed cases" may be split and appealed both to the federal circuit Court of Appeals in Washington DC (for otherwise appealable actions without EEO components) and to U.S. District Court within the appropriate jurisdictional district nationwide (for EEO claims only).

If a final decision from MSPB includes decision on EEO claims in a "mixed case," and if it is appealed in its entirety to the Federal Circuit Court of Appeals (without abandoning the EEO claims), it will be dismissed for lack of jurisdiction; because the Federal Circuit Court of Appeals lacks jurisdiction to review the EEO claims. Such jurisdiction properly belongs to U.S. District Courts, whose decisions can be appealed further to the U.S. Circuit Court of Appeals within the appropriate jurisdictional region nationwide.
