Beware of HR staff and Attorneys

EEO counselors and EEO investigators work for the federal agency, which employs them. They do not advocate complainants.

HR staff too are employed by the management, whom they work for. For that reason generally they are not your friends.

Many current administrative judges (AJ’s) at EEOC or MSPB used to work for federal agencies as in-house attorneys. They gain experience representing the agency and, after a few years, apply for and usually obtain AJ positions at either EEOC or MSPB. AJ’s are attorneys, not really judges, unlike administrative law judges or federal judges.

Private attorneys do not fair much better. Like any other companies or corporations, their bottom line is profit or to be a rainmaker. If an attorney is honest, he or she may not be diligent. If he or she is diligent, he may not be honest. If he or she is both, he or she may not be versed in the federal EEO process, or the MSPB proceedings, or in mixed cases.
